Потребителска организация е внесла колективен иск срещу "Профи кредит"

Една от най-големите небанкови институции в България - "Профи кредит" e обект на недоволство от страна на потребителите на бързи кредити. "Сдружението за правна помощ на потребителите" се е спряло точно на тази небанкова институция, защото сигналите на граждани към нея за най-много.

11 клаузи в общите условия на кредитната институция оспорва пред съда потребителската организация. Основните възражения на сдружението са, че в договора за отпускане на заем "Профи кредит" поставя допълнителни условия, които не са изискани от закона, с което накърнява интересите на потребителите и води до неравнопоставеност. Изискванията за охраняване, плащане в срок на други публични задължения, както и възможностите, предвиждащи автоматична предсрочна изискуемост на заема с нетипични за договор за кредит и водят до затворен кръг, в който попадат лицата, получили заема. Предложенията на кредитната институция в такива ситуации са за рефинансиране. Длъжниците също така трябва да информират "Профи кредит" в случай, че възникнат обстоятелства, които могат да повлияят негативно на погасянето на кредита.

В отговор на внесения в съда колективен иск от финансовата интституция е изпратено отворено писмо до медиите, в което се казва, че общите условия на ПРОФИ КРЕДИТ България ЕООД са съгласувани с Комисията за защита на потребителите и същата като регулаторен орган е изразила становището си, че в общите условия на ПРОФИ КРЕДИТ България ЕООД не са налице неравноправни клаузи.

Ако бъде спечелено делото срещу тази конкретна фирма за бързи кредити, правното решение ще важи за всички други фирми в сектора, посочват адвокатите от сдружението.
