В становище на БСК, адресирано до управляващите, представителната бизнес организация изрази несъгласието си със създадената допълнителна административна тежест чрез вменяване на задължение за подаване до Държавна агенция „Национална сигурност“ на плановете за въвеждащо и продължаващо обучение за запознаване с изискванията на ЗМИП на тридесет и пет категории задължени лица по чл. 4 от закона. 

От БСК подчертават, че за да бъдат изпълнени изискванията на ППЗМИП и съответно, избегнати санкции, десетки хиляди икономически, консултантски и нестопански субекти са били принудени да подходят чисто формално и да върнат подписани обратно към ДАНС публикуваните от институцията два дни преди изтичането на крайния срок примерни планове за обучение.

Изказани са съмнения за необходимостта абсолютно всички задължени по настоящем лица да останат такива, като изрично е посочено, че сдруженията с нестопанска цел, с изключение на фондациите не попадат в изброените в Директива (ЕС) 2015/849, която задължава държавите-членки да предприемат мерки за участие на съответните служители в специални програми за обучение, които да им помогнат да разпознават операциите свързани с изпиране на пари или финансиране на тероризма и да ги инструктират как да действат в такива случаи.

Под въпрос е поставена и възможността на ДАНС да обработи всички постъпили и очакваните в бъдеще по всяка мярка на закона няколко десетки хиляди документа.

Представителите на бизнеса отправят в становището си искане за законодателни промени, с които:

  1. Да се въведе диференциран подход при определяне на мерките, съответстващ на степента на риска за отделните категории задължени лица, с цел осигуряване на ефективност и пропорционалност на целите на ЗМИП.
  2. Да отпадне изискването за ежегодно изпращане до ДАНС на обучителни програми от задължените лица. Примерни обучителни програми да бъдат публикувани на страницата на ДАНС в началото на всяка година.
  3. Да се установи подходящ механизъм за подпомагане и контрол от страна на ДАНС за изпълнение на мерките в закона и правилника, включително по осъществяване на обучителни програми и изготвяне на вътрешни правила, който изключва непосилни ангажименти на задължените по ЗМИП лица.
  4. Сдруженията с нестопанска цел да бъдат изключени от обхвата на чл. 4 от ЗМИП.
