В становище на НАП са разгледани разпоредбите на ЗДДС за прилагане на нулева ДДС ставка за медицински изделия, предназначени за диагностика на COVID-19 в сила от 01 януари 2021 г. до 31 декември 2022 г. включително.

В рубриката "Становища, указания, наръчници" в интерент страницата на НАП са публикувани разяснения относно прилагането на нулева ставка на данъка върху добавената стойност за доставка на медицински изделия, предназначени за диагностика на COVID-19, както и на услугите, пряко свързани с тези изделия, съгласно разпоредбата на чл. 36б и за вътробщностно придобиване на основание чл. 64а от Закона за данък върху добавената стойност в сила от 01 януари 2021 г. до 31 декември 2022 г. включително.

Документът съдържа обобщена информация за съдържанието и целта на нормите, включително дефиниция на понятието „ин витро диагностично медицинско изделие“. Разгледан е подробно обхватът на приложение на разпоредбите, като в отделни точки са представени икономическите операции, по отношение на които е приложима нулевата ставка; видовете изделия, които се облагат с нулевата ДДС ставка и такива, за които тя не се прилага; правилата за третиране на услуги, пряко свързани с доставката на медицински изделия, предназначени за диагностика на COVID-19; правото на данъчен кредит, както и правилата за разграничаване на доставка на услуга, пряко свързани с доставката на изделия за диагностика на COVID-19, от освободена доставка на медицински услуги.
