НАП разяснява в становище прилагането на намалена ДДС ставка от 9% за книги

В становище, публикувано в интернет страницата на НАП, от приходната агенция разясняват прилагането на разпоредбата на чл. 66, ал. 2, т. 2 от Закона за данък върху добавената стойност в сила от 01.07.2020 г.

В документа, допълващ писмо с изх. № 20-00-100/29.07.2020 г., в 26 страници са разгледани:

- съдържание на нормата

("Съгласно чл. 66, ал. 2, т. 2 от ЗДДС, в сила от 01.07.2020 г. до 31.12.2021 г., ставката на данъка е 9 на сто за доставка на книги на физически носители или извършвана по електронен път или и двете (включително учебници, познавателни книжки и учебни комплекти, детски книги с илюстрации, за рисуване или оцветяване, печатни или ръкописни нотни издания). 

Намалената данъчна ставка не се прилага за публикации, които са изцяло или основно предназначени за реклама, както и за публикации, които са изцяло или основно съставени от видеосъдържание или аудио-музикално съдържание. Същите се облагат със стандартната данъчна ставка от 20 на сто.

Намалената данъчна ставка относно книгите се прилага за:- доставката им с място на изпълнение на територията на страната (продажбите им както от производители (издатели), така и от търговци);

 

  • - вноса им на територията на страната;
  • - вътреобщностното им придобиване на територията на страната;
  • - услугата по предоставянето им по електронен път с място на изпълнение на територията на страната.)
  • - съдържание на понятията, определящи обхвата на намалената данъчна ставка по чл. 66, ал. 2, т. 2 от ЗДДС;

- обхват на приложение на намалената данъчна ставка по чл. 66, ал. 2, т. 2 от ЗДДС по отношение на доставките на книги на хартиен или друг физически носител (касети, дискове, CDs, DVDs, CD-ROMs, USB памет и други, които възпроизвеждат предимно същото информационно съдържание катo на отпечатаните книги) и доставки на книги по електронен път, както и доставката на книги втора употреба;

- съпътстващи разходи, с които се увеличава данъчната основа на доставка на книга;

- доставка на комплектувани продукти с обща цена;

- разграничаване от освободени доставки;

- приложението на нормата относно ISBN код;

- разграничаване от доставки на услуги.
