Промени в правилника за прилагане на ЗДДС са публикувани за обществено обсъждане

Предложение за промени в ППЗДДС е публикувано за обществено обсъждане на 30 май 2022 г. Законодателната инициатива предвижда конкретизиращи и уточняващи разпоредби относно корекцията на данъчни документи, коригирането на начисления данък и ползвания данъчен кредит в случаите на грешно данъчно третиране на доставка при наличие на влязъл в сила акт, издаден от орган по приходите.

Предложение за промени в ППЗДДС
Проекти

Проект за промени в Правилника за прилагане на Закона за данък върху добавената стойност е публикуван в Портала за обществени консултации на МС. Срокът за адресиране на становища изтича на 26 юни 2022 г. В мотивите към проекта като повод за инициативата се посочва необходимостта на национално ниво да бъде нормативно регламентирана възможността да се коригира фактуриран данък, който не е следвало да бъде начислен, при положение че издателят на фактурата докаже своята добросъвестност, включително при влязъл в сила ревизионен акт.

Като друга цел е посочено допълването на съществуващи и въведени със ЗДДС правила в действащата система на ДДС в контекста на доставките на услуги и дистанционните продажби на стоки и някои вътрешни доставки на стоки, предвид което са предложени промени, свързани с прецизиране на разпоредби във връзка с прилагането на режим извън Съюза, режим в Съюза и режим за дистанционни продажби на стоки, внасяни от трети страни или територии. В допълнение се предвижда с промените да бъде постигнато и прецизиране на разпоредби във връзка с удостоверяването на доставки, облагаеми с нулева ставка, както и съобразяване на ДДС законодателството с направени промени други нормативни актове – Законът за Регистър БУЛСТАТ.

Проектът за изменение и допълнение на ППЗДДС и мотивите към него са публикувани за обществено обсъждане на 30.05.2022 г. Текстовете на двата документа могат да бъдат изтеглени и от линковете по-долу.
