НАП публикува становище прилагане на ЗМДВИП във връзка със срокове по ДОПК и материалните данъчни закони

НАП публикува Становище № 20-00-54/27.03.2020 г. по прилагане на Закона за мерките и действията по време на извънредното положение, обявено с решение на Народното събрание от 13.3.2020 г., обн. с ДВ, бр. 28/24.03.2020 г., във връзка със срокове по ДОПК и материалните данъчни закони.

От приходната агенция обобщават: "В сферата на данъчното и осигурителното законодателство специалните разпоредби са регламентирани с § 25 – 29 от преходни и заключителни разпоредби на Закона за мерките и действията по време на извънредното положение (ЗМДВИП) и същите частично отменят, както общите норми на ДОПК, материалните данъчни закони и Кодекса за социално осигуряване (КСО), които преуреждат, така и общите норми на ЗМДВИП." 

Друго важно пояснение в прессъобщението на НАП гласи: "От разпоредбата на § 49 на преходните и заключителни разпоредби на ЗМДВИП  следва, че регламентацията, уредена в материалните данъчни закони и ДОПК, се запазва по отношение на сроковете и съдържанието на част от производствата, а именно:

  • установяване на задължения за данъци и осигурителни вноски; 
  • деклариране – извън приложението  на § 25, § 27, ал. 2 и 3 и § 28 от ПЗР;
  • внасяне - извън приложението на § 25, § 26, § 27 и § 28 от ПЗР;
  • обезпечаване и
  • събиране – извън § 29 от ПЗР."
