Допълнителни текстове в Закона за данък върху добавената стойност ще ограничават възможностите за данъчни измами с ДДС в търговията с течни горива.

Това предвижда публикуваният за обществено обсъждане проект на финансовото министерство, в който се предлага механизъм, съгласно който, при осъществяване на търговия с течни горива, лицата задължително да предоставят обезпечение в пари, държавни ценни книжа или в безусловна и неотменяема банкова гаранция за срок една година пред компетентната териториална дирекция на НАП.

С предложените текстове се регламентира това задължение да възниква, когато регистрирано по ЗДДС лице за текущия данъчен период е извършило облагаеми доставки на течни горива с обща стойност на данъчните основи по доставките над 25 хил. лв., вътреобщностно придобиване на течни горива с обща стойност на данъчните основи на придобиванията над 25 хил.лв. или освобождава течни горива за потребление по чл. 20 от Закона за акцизите и данъчните складове на стойност над 25 хил. лв.

В мотивите към проекта е посочено, че този режим ще се прилага по отношение на търговците с течни горива, които са рискови. Като такива са посочени вложителите в данъчните складове (66,3% от броя на вложителите в данъчни складове през 2015 г. се идентифицират като рискови лица), както и лица, посредници в търговията с течни горива. Злоупотребите с ДДС са с висока концентрация в този сектор, тъй като скоростта на обращение на паричните средства в него е висока, а инкасирането на стойността на горивата е в интервал, близък или идентичен с този на самата доставка, отбелязват авторите на законодателната инициатива. Разгледани са също така и най-често срещаните механизми, използвани за укриване и невнасяне на данъчни задължения, свързани с доставки на течни горива от лицата, участващи в схеми за измами с ДДС.

Проектът е отворен за обсъждане до 1 юни 2016 г.
