ЕК поиска от България да синхронизира ДДС законодателството си с правото на ЕС

В официално увдомително писмо Европейската комисия ще поиска от България да промени нормативната уредба в областта на облагането с ДДС на дружествата, търгуващи с горива. Необходими според ЕК са и промени в разпоредбите относно ДДС, приложими за използването на активите на дружествата за нестопански цели. 

Първата промяна е поискана във връзка с настоящата практика малките дружества, търгуващи с горива, задължително да плащат авансово прекомерно високи суми, за да гарантират, че могат да платят дължимото от тях ДДС. За големите дружества е достатъчно само да внесат гаранция в размер, равен на дължимото по сделките им ДДС. Това според Еврокомисията прави националното законодателство несъвместимо с нормите на ЕС (Директивата за ДДС, Директива 2006/112/ЕО на Съвета) и със свободата на стопанска инициатива (член 16 от Хартата на основните права на ЕС).

От ЕК приканват страната ни също така да промени правилата си за начисляване на дължимия ДДС в случаите когато стопански активи се използват за частни или нестопански цели и когато стопански активи се прехвърлят в друга държава членка. 

Срокът, в който България трябва да предприеме действия в отговор на двете искания на Европейската комисия, е кратък - следващите два месеца. След изтичането му в случай, че не бъдат взети необходимите мерки за привеждане на ДДС законодателството ни в  в съответствие с правото на ЕС,Комисията може да реши да изпрати мотивирано становище.
