Законопроект за промени в Закона за данък върху добавената стойност, внесен в НС на 21 ноември, предлага да бъде значително облекчен режимът за предоставяне на обезпечение при доставки на течни горива. 

С приетите през юли текстове в ЗДДС беше добавен нов чл. 176в, който регламентира задължението на търговците на течни горива при надвишаване на праг от 25 хил. лв. за облагаеми доставки да предоставят обезпечение в пари, държавни ценни книжа или в безусловна и неотменяема банкова гаранция за срок от една година пред компетентната териториална дирекция на НАП. С предложените в настоящия законопроект промени се предвижда размерът на предоставяното обезпечение да е съобразен с действително извършените доставки, а срокът за предоставяне да бъде намален от една година на един месец. В мотивите си авторите на законодателната инициатива посочват, че действащата в момента нормативна уредба противоречи на принципа на данъчния неутралитет и на общностното право в частта, в която се прилага по-облекчен режим при внос спрямо ВОП. Освен това механизмът на практика налага и двойно данъчно облагане на задължените лица, които наред с блокираните им оборотни средства внасят и дължимия ДДС за същия данъчен период.

С Преходните и заключителни разпоредби на проекта се предлагат и промени в ЗАДС, целящи облекчаване на регулационнитережими и изискванията при издаване на лиценз за управление на данъчен склад.
