Регистрираните като земеделски производители физически лица имат право да изберат реда, по който ще бъдат облагани доходите от дейността им за 2015 г. Подаването на декларацията, с която се упражнява правото на избор, трябва да бъде извършено до 31 декември. 

Доходите на физическите лица - земеделски производители се облагат по реда на Закона за данъците върху доходите на физическите лица (ЗДДФЛ) с  данък върху общата годишна данъчна основа, ако не са търговци по смисъла на Търговския закон или не са избрали да се облагат по реда, предвиден в ЗДДФЛ за едноличните търговци. 

В случай, че земеделците изберат обалгане като еднолични търговци, те трябва да прилагат този ред за срок не по-кратък от 5 последователни данъчни години. Доходите им се обалгат с данък върху годишната данъчна основа по чл. 28 от ЗДДФЛ. В този случай лицата имат възможност да отчитат реално извършените разходи за производството на преработени или непреработени продукти от селско стопанство, с изключение на разходите за производство на декоративни растения. 

При облагане по реда, предвиден за едноличните търговци, регистрираните като земеделски производители физически лица  не могат да ползват правото за преотстъпване на данъка върху годишната данъчна основа при условията за преотстъпване на корпоративен данък по чл. 189б от Закона за корпоративното подоходно облагане.  

Правото на избор за облагане с данък върху годишната данъчна основа се упражнява чрез подаване на декларация по чл. 29а, ал. 4 от ЗДДФЛ, като веднъж подадена, декларацията важи за целия петгодишен период, през който лицето ще се облага по реда, предвиден за едноличните търговци. Декларацията се подава лично от земеделския производител или негов упълномощен представител в офис на НАП по постоянен адрес. Декларацията може да бъде подадена и чрез пощенски оператор.
